By purchasing, enrolling in, accessing, or participating in an ElmElara course, you acknowledge that you have read, understood, and agreed to these Terms and the other ElmElara policies applicable to your purchase or participation.

If you do not agree to these Terms, please do not purchase, enroll in, access, or participate in an ElmElara course.

• Not video-based
• Not provided as downloadable course materials
• Not provided with physical textbooks or physical course materials
• Intended to be accessed through the authorized ElmElara learning platform

Courses may include lessons, explanations, exercises, quizzes, assessments, activities, interactive elements, and other educational content depending on the course.

3. Educational purpose

ElmElara courses are provided for educational and informational purposes.

Course content may provide instruction, explanations, practice, activities, assessments, educational guidance, or other learning resources described on the applicable course page.

Course content does not constitute individualized legal, medical, financial, academic, professional, or other professional advice unless expressly stated otherwise.

Students, parents, guardians, educators, businesses, and other purchasers are responsible for determining how and whether information presented in a course is appropriate for their individual circumstances.

Completion of an ElmElara course does not guarantee academic, professional, employment, business, financial, or other specific results.

4. Course scope and credentials

Unless expressly stated otherwise in writing, completion of an ElmElara course does not constitute or provide:

• Academic accreditation
• College credit
• A degree or diploma
• A regulated professional qualification
• Authorization to practice a regulated profession
• Continuing-education credit
• Guaranteed employment
• Guaranteed professional advancement

ElmElara does not represent that completion of a course will satisfy the requirements of any particular school, college, university, employer, licensing board, government agency, professional organization, or other institution unless expressly stated in writing.

Customers are responsible for determining whether a particular course meets their individual educational, professional, licensing, employment, school, continuing-education, or other requirements.

5. Parent and legal guardian purchases

Courses intended for children or minors are purchased and enrolled by a parent or legal guardian.

The parent or legal guardian is responsible for:

• Completing the purchase
• Providing accurate account and billing information
• Reviewing the applicable course information
• Reviewing the recommended age or learning level
• Determining whether the course is appropriate for the child
• Supervising the child’s participation when appropriate
• Ensuring that the child uses the course appropriately
• Maintaining the security of the parent account

ElmElara’s primary customer and account holder for a parent-purchased children’s course is the purchasing parent or legal guardian.

A child is not authorized to independently purchase a course on behalf of a parent or legal guardian.

6. Parent information and child participation

ElmElara’s children’s courses are designed so that the parent or legal guardian completes the purchase and provides the information necessary to establish and administer the account.

ElmElara does not require a child to provide payment information or independently purchase a course.

ElmElara does not intentionally request unnecessary personal information directly from a child.

Depending on the course and platform functionality, ElmElara may process limited information associated with a child’s participation when necessary to provide or administer the course.

The specific information collected and processed is governed by the ElmElara Privacy Policy and any applicable Children’s Privacy Policy.

Parents and legal guardians should avoid providing unnecessary personal or sensitive information about a child when communicating with ElmElara.

7. Parent supervision

Parents and legal guardians are responsible for determining whether a course is appropriate for their child and whether supervision is appropriate.

Parents and legal guardians should consider the child’s:

• Age
• Reading level
• Educational level
• Ability to use the required technology
• Individual learning needs
• Ability to understand course instructions

ElmElara does not guarantee that a particular course will be appropriate for every child within a stated age or grade range.

8. Course purchases and enrollment

When you purchase or enroll in an ElmElara course, you are purchasing access to the online educational content and learning experience specifically described on the applicable course page.

Course access is provided through the designated ElmElara website, platform, or authorized online learning environment.

The lessons, activities, assessments, features, access period, and other components included with a purchase may vary by course.

Please carefully review the applicable course page before completing your purchase.

9. Course sales, refunds, and cancellations

ElmElara course purchases are generally final and non-refundable.

Except where ElmElara expressly provides a refund or where a refund, cancellation, replacement, or other remedy is required by applicable law, ElmElara does not provide refunds, exchanges, credits, or transfers solely because of:

• Change of mind
• Lack of time to complete the course
• Failure to complete the course
• Personal circumstances
• Scheduling conflicts
• Changes in educational circumstances
• Deciding that the course is not the right fit
• A child losing interest
• A child finding the course too difficult or too easy
• Failure to achieve a desired result
• Failure to review course information before purchasing
• Failure to implement information provided in the course

If ElmElara fails to provide the purchased course or materially fails to provide the course as described at the time of purchase, ElmElara will make reasonable efforts to correct the issue and provide an appropriate remedy where required by applicable law.

A technical issue that prevents access to a purchased course will be addressed under the Technical support section of these Terms.

Nothing in this section excludes, restricts, or waives any refund, cancellation right, consumer protection, warranty, or other remedy that cannot legally be excluded, restricted, or waived.

10. Payment

Unless a payment-plan or installment option is expressly offered by ElmElara at checkout, course purchases must be paid in full at the time of purchase.

ElmElara does not offer payment plans, installment arrangements, deferred payments, or financing outside of payment options expressly displayed and authorized at checkout.

If an authorized third-party payment provider offers financing or an installment option at checkout, that arrangement is subject to the provider’s separate terms and conditions.

11. Course access

Course access is provided to the individual purchaser unless the applicable course is expressly sold to a school, classroom, business, organization, or other authorized group.

You may not share, transfer, sell, give away, sublicense, or otherwise provide individual course access to an unauthorized person.

Login credentials must be kept confidential.

You are responsible for maintaining the security of your account and login information.

ElmElara may suspend or terminate access if we reasonably determine that account credentials or course access are being shared or misused, subject to applicable law.

12. School, classroom, and business access

Certain ElmElara courses may be purchased for use by schools, classrooms, businesses, organizations, or groups.

Unless a group, classroom, school, business, or organizational license is expressly purchased or granted in writing, an individual course purchase provides access only to the individual purchaser and authorized learner.

A purchaser may not distribute individual course access to students, employees, coworkers, clients, customers, or other individuals without an authorized group or organizational license.

Where a group or organizational license is offered, the number of permitted users and permitted uses will be determined by the applicable purchase or written agreement.

13. Course access period

Unless otherwise stated on the applicable course page, course access is provided for the access period specified at the time of purchase.

If a course is advertised as providing “lifetime access,” lifetime access means access for as long as ElmElara continues to make the applicable course materially available through its platform, subject to these Terms and applicable law.

Lifetime access does not guarantee that a particular third-party platform, hosting provider, website, technology, or feature will remain available indefinitely.

ElmElara may update, relocate, replace, or modify its course-delivery technology when reasonably necessary.

14. Course content and intellectual property

All course content and educational materials provided through the ElmElara learning platform are owned by, licensed to, or otherwise controlled by ElmElara, unless otherwise stated.

This may include:

• Online lessons
• Written educational content
• Interactive course content
• Exercises
• Quizzes
• Assessments
• Course graphics
• Course designs
• Text-based educational materials
• Interactive activities
• Website content
• Other materials made available within the authorized course platform

Course content is provided for the purchaser’s personal educational use unless a separate written agreement provides otherwise.

Your purchase provides a limited right to access and use the course for its intended educational purpose. It does not transfer ownership of ElmElara intellectual property to you.

Nothing in these Terms prohibits conduct expressly permitted by applicable law.

15. Prohibited use of course content

Without prior written permission from ElmElara, you may not:

• Screen-capture or otherwise reproduce substantial portions of course content
• Share course content with unauthorized individuals
• Upload course content to another website or platform
• Sell or resell course content
• Give course access to an unauthorized person

• Modify and redistribute course content
• Use course content for unauthorized commercial training
• Remove copyright, trademark, or other proprietary notices

Unauthorized use may result in termination of course access and may result in additional legal remedies where permitted by law.

16. Unauthorized sharing and distribution

Sharing or distributing course access or course content with individuals who have not purchased or been authorized to access the applicable course is prohibited.

This includes unauthorized sharing of:

• Login credentials
• Course links
• Account access
• Screenshots
• Course text
• Interactive course content
• Exercises
• Quizzes
• Assessments
• Other proprietary course materials

ElmElara reserves the right to investigate suspected unauthorized access, sharing, reproduction, or distribution and take appropriate action to protect its intellectual property.

17. Course results and guarantees

ElmElara does not guarantee that a student will achieve a particular result from completing a course.

ElmElara does not guarantee:

• Grades or academic performance
• Improved test scores
• Admission to a school or college
• Employment
• Promotions
• Income
• Revenue
• Profit
• Business growth
• Client acquisition
• Professional success
• Certification
• Licensing
• College credit
• Specific skill levels
• Specific test or examination results
• Any other particular personal, academic, educational, or professional outcome

Results may vary based on individual experience, age, skill level, effort, implementation, educational background, learning needs, market conditions, business decisions, location, applicable requirements, and circumstances outside ElmElara’s control.

Examples, testimonials, demonstrations, or statements regarding potential outcomes are illustrative and should not be understood as guarantees.

18. Technical requirements

Customers are responsible for having the equipment, software, browser, and internet connection reasonably necessary to access the course.

Depending on the course and platform, this may include:

• Compatible computer, tablet, or mobile device
• Internet connection
• Supported web browser
• Email access
• Required software or applications
• Appropriate device capabilities

ElmElara is not responsible for technical difficulties caused by a customer’s device, internet provider, browser, software, operating system, or other circumstances outside ElmElara’s reasonable control.

19. Technical support

If you experience a legitimate technical problem accessing a purchased course, please contact ElmElara through the designated support channel.

Please include your name, order information, and a description of the issue.

ElmElara will make reasonable efforts to assist with legitimate course-access or technical issues.

Technical support does not create a refund right unless otherwise required by applicable law.

20. Course updates and changes

ElmElara may update, improve, correct, reorganize, or modify course content, lessons, activities, assessments, interactive elements, platforms, or other course materials when reasonably necessary.

Course materials may change over time to reflect corrections, updated information, improvements, technology changes, or other reasonable educational or operational needs.

Where appropriate, ElmElara may provide reasonable notice of significant changes.

ElmElara will not intentionally remove or materially reduce the core content of a purchased course in a manner inconsistent with the applicable purchase description, except as permitted by applicable law.

Routine updates, corrections, reorganizations, or improvements do not automatically create a right to a refund.

21. Community and student conduct

If an ElmElara course includes a private community, discussion area, live interaction, social platform, or other interactive environment, participants are expected to conduct themselves respectfully and appropriately.

Prohibited behavior includes:

• Harassment
• Threats
• Bullying
• Hate or discriminatory conduct
• Intimidation
• Spam
• Unauthorized advertising
• Unauthorized solicitation
• Sharing another student’s private information
• Disruptive behavior
• Unauthorized distribution of course content
• Fraudulent or unlawful activity

ElmElara may remove a participant from an interactive environment or terminate access for serious or repeated violations, subject to applicable law.

22. Chargebacks and payment disputes

Customers are encouraged to contact ElmElara before initiating a payment dispute so that ElmElara has an opportunity to investigate and address legitimate concerns.

If a chargeback or payment dispute is initiated, ElmElara may provide the applicable payment processor, financial institution, or other authorized party with relevant transaction documentation as permitted by applicable law.

This may include:

• Purchase confirmation
• Payment records
• Customer information provided at checkout
• Acceptance of applicable Terms & Policies
• Enrollment records
• Course-access records
• Login activity
• Customer communications
• Refund or cancellation records
• Relevant technical-access records

Nothing in this section restricts a customer’s legal right to dispute an unauthorized or otherwise improper transaction.

23. Termination of course access

ElmElara may suspend or terminate course access if a student or purchaser violates these Terms, including through unauthorized sharing, distribution, reproduction, resale, or misuse of course content.

Termination resulting from a violation of these Terms does not entitle the purchaser or student to a refund, except where otherwise required by applicable law.

24. Limitation of liability

To the fullest extent permitted by applicable law, ElmElara will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to participation in or use of an ElmElara course.

Nothing in this section excludes, restricts, or waives any liability, warranty, consumer right, or remedy that cannot legally be excluded, restricted, or waived.

Nothing in this section limits liability to the extent such limitation is prohibited by applicable law.

25. Governing law

These Online Courses Terms & Policies shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles, except to the extent applicable law requires otherwise.

Nothing in these Terms is intended to limit or waive any consumer rights or protections that cannot legally be excluded or waived.

26. Policy changes

ElmElara may update or modify these Online Courses Terms & Policies from time to time.

The updated version will be posted on the ElmElara website with the applicable Effective Date.

Changes will generally apply prospectively and will not retroactively modify rights or obligations that have already accrued, except where permitted or required by applicable law.

For material changes that require affirmative acceptance under applicable law or platform requirements, ElmElara may require customers to affirmatively accept the revised Terms before continued access.

Continued use of an ElmElara course after a revised policy becomes effective may constitute acceptance of the revised Terms to the extent permitted by applicable law.

27. Agreement to terms

By purchasing, enrolling in, accessing, or participating in an ElmElara course, you acknowledge that you have read, understood, and agreed to these Online Courses Terms & Policies and the other ElmElara policies applicable to your purchase or participation.

If you do not agree to these Terms, please do not purchase, enroll in, access, or participate in an ElmElara course.

Parent course purchase acknowledgment

For courses intended for children or minors, the purchasing parent or legal guardian may be required to acknowledge the following before completing the purchase:
